Food giant, Mission Taco agree on terms to settle trademark infringement lawsuit

ST. LOUIS — Mission Taco Joint and Gruma Corp. in a joint notice filed Friday in U.S. District Court for the Eastern District of Missouri said they have agreed on terms to resolve their lawsuit.

Irving, Texas-based Gruma in October sued Mission Taco, claiming the local, West Coast-style taco restaurant chain was infringing on trademarks for Gruma's Mission brand of tortillas, chips and other products.

Adam Tilford, who co-owns Mission Taco, and the company’s attorney, Michael Hickey of Lewis Rice, both could not immediately be reached for comment. Neither Gruma nor its attorney, Brendan Bement of Thompson Coburn LLP, could immediately be reached for comment.

“All parties anticipate execution of a final settlement agreement and filing a dismissal within 60 days of this notice and request the Court stay all deadlines in the case pending dismissal,” court documents filed Friday say.

Gruma, which sells Mission products in groceries, said in its lawsuit that it became aware of Mission Taco at the 2023 Tortilla Industry Association meeting in Austin, Texas.
