St. Louis thrift store chain sues City Foundry shop

Found By The Pound LLC wants to prevent the Foundry shop from using its mark.

ST. LOUIS — A St. Louis chain of thrift stores on Friday sued a City Foundry shop, alleging trademark infringement.

Found By The Pound LLC, which has three stores (Delmar Loop, South Grand and Berkeley), sued Found Fashion LLC in St. Louis Circuit Court, seeking damages and an order preventing Found Fashion from using its mark.

Found By The Pound, organized by Christine Mace, said it has used its mark since the Berkeley store opened in 2016. The South Grand store opened in 2017 and the Delmar store in 2021. And it said that since 2021, 37,000 pieces of clothing have gone "out the door" of its shops with "FOUND" retail tags on them.

Found Fashion, organized by Osama Ramadan, opened at City Foundry in September, according to the lawsuit. "'Actual confusion' ensued immediately as numerous customers began congratulating (Found by the Pound) for opening a fourth store in the trendy City Foundry," the suit said.
