Judge voids permit for Downtown West Shell station

The ruling doesn't guarantee the business will close, but represents a significant milestone for downtown stakeholders who see it as a nuisance property.

ST. LOUIS — A state-court judge earlier this month voided a conditional use permit the city of St. Louis previously granted to the Shell gas station at 721 N. Tucker Blvd. in Downtown West.

The ruling doesn't guarantee the business will close, but represents a significant milestone for downtown stakeholders who see it as a nuisance property that attracts crime.

The ruling, from St. Louis Circuit Court Judge Michael Stelzer, came in a lawsuit brought by the Neighborhood Improvement Association-Downtown West and resident Matt O'Leary, who claimed that when the business was issued a conditional use permit in 2003, gas stations weren't — and still aren't — an allowed use in the area, known as a central business district.

Stelzer agreed, and declared the permit void. He ordered the parties to submit proposed orders on the issue later this month.
