St. Charles County seeks to intervene in fight over local marijuana taxes

ST. CHARLES COUNTY, Mo. — Officials with St. Charles County said Thursday they had filed to intervene in a case challenging whether counties can implement 3% sales taxes on marijuana sales.

The move comes in a case brought by the operator of a dispensary in Florissant, which sued after it was notified by the Department of Revenue that its sales tax rate for recreational marijuana sales would be 14.988%. That is the regular tax rate of 8.988% in Florissant plus the city and St. Louis County marijuana sales tax.

Robust is suing the Department of Revenue and St. Louis County, seeking a court order blocking collection of the county tax, claiming it's unconstitutional under the marijuana amendment that launched recreational sales earlier this year.

St. Charles County, like St. Louis County and the city of St. Louis, has passed a countywide marijuana tax.
