The legal fight continues for a Jefferson County businessman trying to turn a shuttered mine into a climate-controlled cave that hosts rock concerts, sporting events and conventions.

CRYSTAL CITY, Mo. (AP) - The legal fight continues for a Jefferson County businessman trying to turn a shuttered mine into a climate-controlled cave that hosts rock concerts, sporting events and conventions.

Tom Kerr and his wife, Kathy, converted the dormant sand mine into Crystal City Underground after buying the property. The expansive cave has hosted electronic dance music concerts, international pole vaulting competitions, extreme-sport kayakers and kid-friendly treasure hunts.

Jefferson County says Kerr is thumbing his nose at development laws he agreed to abide by when the county agreed to rezone his property in 2011.

The cave owner now argues that his venue should be overseen by the state Department of Labor and Industrial Relations, which monitors mines and caves.

The two sides are awaiting a ruling by a Hillsboro municipal judge.
